Introduction

The Terms shall govern the use of and access to the website www.deutschactiv.com (the “Website”) accessible through desktops, mobile phones, smartphones and tablets which includes the computer software, associated media, collaterals, and online or electronic documentation. Astute Academy is the owner of the Website and by accessing, or otherwise using the Website, You agree to be bound by the Terms.

Please carefully go through these Terms and the privacy policy available at www.deutschactiv.com/ privacy (“Privacy Policy”) which together constitutes a legal agreement (“Agreement”) between you and the Company in connection with your access and use of the Website and the information offered thereunder.

We request You to please read these Terms carefully and do not continue the use of the Website and/or information offered unless You agree fully with these Terms.

Use of the Website by Users

Fees: 

Fees are inclusive of tuition fees, book-set, study material and GST.
Fees can be paid in 1 or 2 instalments. In case of payment in installments, 50% of the course fees must be paid before the commencement of the batch or a date declared by the institute and the remaining fees must be paid in the fourth week of the batch or on a date declared by the institute. Fees once paid are non-refundable and non-transferable.

Admission, Batches & Attendance: 

100% attendance is required.
In case of online lectures, Students must have a laptop and an uninterrupted internet connection to attend the lectures. Deutsch Activ solely reserves the right of admission & student can choose the number of level/s he or she wants to join for. Absenteeism – All courses require 100% attendance. In case of absenteeism exceeding more than 5 days, without prior notice and consent from the institute on email, the student may be prohibited by the institute to attend any further lectures without any refund of the paid fees. Absenteeism beyond 5 days, disqualifies a student from giving the internal examination. The choice of batch and the chosen time slot are binding. Changes are not allowed. Recording of lectures by students is strictly prohibited. 

Rights of photos/videos: 

Deutsch Activ (DA) reserves the right to use any photograph/video taken at any classroom session/event sponsored by Deutsch Activ (DA), without the expressed written permission of those included within the photograph/video. Deutsch Activ (DA) may use the photograph/video in publications or other media material produced, used or contracted by Deutsch Activ (DA) including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc.

Termination /Modification/Suspension: The Company may at any time, terminate its legal agreement with you if you have breached any provision of the Terms (or have acted in manner which clearly shows that you do not intend to, or are unable to comply with the provisions of the terms).If you wish to unsubscribe from Deutsch Activ you can send an email to the Company at info@deutschactiv.com to unsubscribe. You may terminate this Agreement with the Company by discontinuing use of this Website.

We may update or change the Website and/or Information provided therein from time to time and recommend that You review these Terms on a regular basis. You understand and agree that your continued use of the Website after the Terms have been updated or changed constitutes Your acceptance of the revised Terms.

Notwithstanding anything to the contrary in these Terms, we have the right, on providing notice to You, immediately to terminate, suspend, or amend your use of the Website, without liability: (a) to comply with any order issued or proposed to be issued by any governmental agency; (b) to comply with any provision of law, or (c) if performance of any term of these Terms by either Party would cause it to be in violation of law. Upon Termination, Company retains the right to use any data collected from your use of the Website for internal analysis and archival purposes. You agree to indemnify and hold the Company, and its officers, managers, members, affiliates, successor, assigns, directors, agents, suppliers, and employees harmless from any claim or demand, including reasonable attorneys’ fees and court costs, made by any third party due to or arising out of the Termination of Terms.

Cancellation, Return & Refund policy: Fees once paid are not refundable.

Arbitration

1) Any dispute, claim or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this Agreement to arbitrate, or to Your use of the Website or the information to which it gives access, shall be determined by Arbitration in India, before a single arbitrator in accordance with the Arbitration and Conciliation Act 1996 along with all amendments. The venue of such arbitration shall be Pune, India. The governing law of the Agreement shall be the substantive law of India. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the Parties.

2) The Parties shall have the right to apply to a court of competent jurisdiction to obtain interim injunctive relief in respect of any dispute, pending resolution of such dispute in accordance with the Agreement.

Amendments

We may vary these terms and conditions. Any variations become effective on posting on the website. By making a payment through this website after the terms and conditions have been varied you agree to be bound by that variation.

Security

We take reasonable security measures and procedures, and as specified by applicable law, to maintain appropriate physical, technical and administrative security to help prevent the loss, misuse, or unauthorized access, disclosure or modification of Personal Information. While we take these reasonable efforts to safeguard your personal information, you acknowledge and agree that no system or transmission of data over the Internet or any other public network can be guaranteed to be 100% secure. Deutsch Activ German Training Institute will have no liability for cancellation of its services due to force majeure (e.g. unrest, act of war or terrorism, natural calamities, epidemics, pandemics and all other circumstances beyond the control of the contractual parties).Should such cases of extraordinary circumstances or events occur or should there be a change in the existing circumstances or events, caused by factors that are beyond the sphere of influence of Deutsch Activ German Training Institute, the Institute shall reserve the right to make changes in the ongoing course structure (e.g. in terms of time, methodology or format). Should the circumstances not allow the above-mentioned changes, in that case Deutsch Activ German Training Institute shall cancel the course without any alternative offer and financial compensation.
